DUI Defense For Immigrants And Nonimmigrants

If you are convicted of driving under the influence (DUI), you can face serious penalties such as jail time, monetary fines and driver's license suspension. Your insurance company may also increase your rates astronomically. For immigrants, the consequences grow even more — you could face removal from the United States.

Gone are the days of a DUI being only about alcohol. Now, Washington State drivers must also contend with "green DUIs," which imply that an individual was under the influence of marijuana while operating a motor vehicle.

Whether you are a born and raised Seattle resident or an immigrant, you need a defense attorney such as myself who has full understanding of the large scope of these issues. For immigrants and nonimmigrants facing DUI charges involving alcohol or marijuana, do not hesitate to call Trudeau Law for a free initial consultation: 206-388-2798.

Take Immediate Action, And I Will Too

You cannot wait to talk to an attorney about a DUI arrest, and you should choose an attorney who will act with the urgency that your defense requires. As your attorney, I will explore and analyze various parts of the traffic stop, including probable cause for the stop, administration of field sobriety tests, results of blood and breath tests and other key elements.

A Word About Green DUIs

It is legal for people who are 21 and older to smoke recreational marijuana in Washington state, but it is not legal to drive a car while under the influence of the drug. According to the Washington State Liquor and Cannabis Board, the DUI provision initiative "sets a per se DUI limit of 'delta-9' THC levels at greater than or equal to 5 nanograms per milliliter of blood (5 ng/mL)." Under Washington's implied consent laws, you will have to submit to a blood test at the local police station. The blood sample is sent to the Washington State Toxicology Laboratory, and results can take anywhere from one to three months. The measurement results do not take into account that if you are a regular pot smoker, you will always be at the 5 ng/mL level.

Criminal Defense And Immigration Status

Both types of DUIs — alcohol-related and green — can pose tremendous problems for green card holders and deferred action for childhood arrivals (DACA) recipients. A criminal conviction can severely impact your immigration status. As your defense attorney, I will give your case top priority and seek the best possible option for your case. Whether through a dismissal of the charges, getting the charge reduced to reckless driving or other avenue, I vigorously strive to keep you in the United States in good standing.
